ILIAS learning platform user agreement

The learning platform is operated by the Hochschule Fresenius gem. GmbH (hereinafter referred to as HS Fresenius) companies and includes public and private sections. It is available to students, all further members of HS Fresenius, participants in other education measures as well as for the duration of special projects in accordance with authorised cooperation partners (hereinafter all individually and collectively referred to as ‘user’ or ‘users’). The contents of the learning platform is made available to users subject to the administration and fundamentally free-of-charge. The usage rights expire upon the user or users leaving the HS Fresenius or upon termination of an educational measure or a project partnership.

Copyright

The contents on ILIAS are protected by copyright. Using the contents in research and instruction, for information, teaching and learning purposes and utilisation (i.e. copying, downloading and printing of contents) for private purposes are permitted, both however only for the purpose of studying and/or training or further training at the HS Fresenius. All duplication (data carriers, print-outs on paper and other materials, etc.), publication or forwarding to third parties during and following termination of access authorisation are impermissible will be prosecuted under criminal and civil law. In the above-mentioned cases, the HS Fresenius is entitled to terminate the user authorisation immediately and without any prior warning or notification. This also applies to providing access to the contents for third parties not entitled to access (i.e. by forwarding of the personal password).

All users agree that the contributions and contents saved by him or her in ILIAS during the activity for or attendance in or participation in HS Fresenius training and further training measures and following his or her departure from the HS Fresenius or the termination of an educational measure or a project partnership up to the end of the studies of the respective groups or to the end of other educational measures and former participants in the case of a required recourse within the context of a postgraduate study course or training course completed at the HS Fresenius in the faculty on ILIAS can continue to be utilised by the HS Fresenius. To this end, users grant the HS Fresenius and third parties the exclusive rights of use unrestricted in terms of time, place and content to all saved contributions and contents on the ILIAS e-learning platform as well as to archive these for the prescribed duration (database, Website, online and archiving law).

Users are expressly prohibited from allowing third parties access to copyright-protected or other protected contents on ILIAS without the express consent of ILIAS. If a user breaches this obligation, the HS Fresenius reserves the right to block access to ILIAS for the user and to immediately delete the corresponding contents.

Further user obligations

In their contributions (forums, chats, targets of hyperlinks and uploaded files, etc.), users must not use illegal contents, particularly defamatory, libellous, slanderous, pornographic, obscene, violence-glorifying, threatening, demagogic or racist contents, to create links to such and/or advocate crimes or calls others to commit crimes. Advertising ILIAS and the utilisation of ILIAS for advertising purposes are also prohibited. Users are obliged, to the best of their knowledge and belief, to desist from actions and data entries on ILIAS that could result in malfunctions to the overall operation.

In the event of breaches, the HS Fresenius reserves the right to block access to ILIAS for the user and to immediately delete the corresponding contents.

No responsibility is assumed for contents with direct or indirect links and which are outside the influence of the HS Fresenius. There is no assumption of any guarantee for the contents on the learning platform being current and complete. Liability claims against the authors and the operators of the learning platform concerning either material or intellectual damage or other detrimental results pursuant to the use or non-use of any information provided, including any information that is either incomplete or incorrect, are excluded. All use is at the user’s own risk.

Within the context of operating the ILIAS platform, the HS Fresenius collates and uses personal data in accordance with the following provisions:

  1. The personal data made available to us will be exclusively collated, processed and used in accordance with the principles described in this data protection declaration and in strict adherence to the rules of the German Federal Data Protection Act (Bundesdatenschutzgesetz/BDSG) and the German Telemedia Act (Telemediengesetz/TMG).

    We will utilise your personal data exclusively to enable the use of the ILIAS platform for study and training and further training purposes. Under no circumstances will we make your personal data available to third parties for advertising or marketing purposes or pass your personal data on to third parties in any other way.

    With the exception of the mandatory information required for utilising ILIAS (first name, last name, gender, HS Fresenius educational facility, e-mail address, enrolment number, study course or training or further training, site), you decide whether you would like to include further data in your general utilisation profile or ILIAS portfolio (‘Personal data and profile’) and potentially make this fully or partially visible to other ILIAS users (‘Visible to users logged in’, ‘Release of own resources’). Your personal address book, your calendar entries, private notes and e-mail saved in your mailbox are not visible to other users.

  2. For organisational reasons, users currently logged in are displayed in the ‘Active users’ section. The corresponding applies to members of learning groups and members of individual courses.

  3. On various pages, we use so-called ‘cookies’, particularly to structure the utilisation of ILIAS in a user-friendly manner. Cookies are small files which are permanently stored on your computer by your Internet browser. By using so-called first party cookies, we collate general, statistically-relevant data on the visit to ILIAS. These include the date and duration of a visit to our Website and to ILIAS as well as the pages viewed by you. This option is designed to optimise utilisation. Most browsers are set so that they automatically accept cookies]. You can deactivate the permanent saving of cookies or set your browser so that it informs you as soon as cookies are sent. We would like to point out that ILIAS can no longer be used if you completely deactivate cookies in your browser.

  4. The consents given by you vis-à-vis the consent recipient specified in the consent declaration can be revoked at any time with effect for the future. To revoke, you can also use the contact options listed in the ‘Rights of persons affected, data protection questions and contact partners’ section.

  5. Access to your user account and other personal services is only possible after entering your ID and your personal password. We would like to point out that – in accordance with the user agreement – you are obliged to keep your access data confidential at all times.

    In conjunction with your access, we will – for the purpose of data security – temporarily save data on our servers that may permit identification (i.e. IP address, date, time and pages viewed). Evaluation is carried out exclusively for statistical purposes.

    ILIAS uses so-called SSL security (Secure Socket Layer) in conjunction with 256-bit encryption. Encrypted data is identifiable from a closed key or lock symbol in the bottom status bar of your browser. Encryption of the link is by means of high-grade encryption (Camellia-256, 256-bit).

  6. The user account and the data saved to this account are immediately deactivated following termination of the utilisation authorisation (i.e. upon leaving the HS Fresenius).

  7. In accordance with Germany’s Federal Data Protection Law (BDSG/Bundesdatenschutzgesetz), you have the right to view your stored data free-of-charge and, if required, the right to the correction, blocking and deletion of said data. In the event of queries regarding the collation, processing or utilisation of your personal data, for inquiries, correction, blocking or deleting data as well as revoking consents and other problems or questions regarding data protection, please write to support@hs-fresenius.de or our data protection officer datenschutz@hs-fresenius.de.
